Non-Refundable Puppy Application Fee and Deposit Agreement
This agreement (“Agreement”), dated as of the date the application fee is submitted (the “Effective Date”), is between (“Breeder”), and (“Buyer”).
The Buyer agrees to pay a $200 application fee to be placed on the waitlist for a puppy in the size, color and gender that they have specified in their application. Breeder will contact the Buyer in order of Buyer’s place in line for a puppy (this is determined by the time the application and application fee is received) a few days after the litter has arrived to let the Buyer know that there is an available puppy for the Buyer. Breeder will make Buyer aware of upcoming litters that Buyer may receive a puppy from if they are close to the top of the waitlist and will likely receive a puppy from that litter. Breeder will send out a litter announcement a few weeks away from the due date so that Buyer can prepare. When the Buyer has been contacted that there is an available puppy in the litter for the Buyer, a waitlist deposit of $300 is due. The Buyer has 72 hours after being emailed or texted that their puppy is born to pay this or the application fee is forfeit and the Buyer will lose their place in line. If the puppies are already born and the Buyer is submitting an application for a currently available puppy the application fee and waitlist deposit are both due at the same time so it would be a one time deposit of $500.
Non-Refundable Application Fee and Waitlist Deposit.
Buyer acknowledges that the Application Fee and Waitlist fee is non-refundable in all circumstances, including but not limited to if Buyer decides s/he does not want or is no longer able to take the puppy. Upon receipt of the Application Fee, Breeder agrees to place the Buyer on the waitlist in order of application fees received. Upon receipt of the Waitlist Deposit, Breeder agrees to hold the puppy from the litter for Buyer until it has been weaned and is ready for pick up. The Waitlist Deposit shall be made in US Dollars and paid to Breeder via the Good Dog payment platform for the application fee and deposit. Final Balance is due in Cash or Good Dog payment at the time of Puppy Pick Up
Buyer Acknowledgements.
Buyer further acknowledges and agrees that (a) Breeder cannot control litter sizes and that the wait time for puppies can be longer than expected; Breeder will hold Buyer’s application fee for up to a year. If a puppy in the Buyer’s size, gender, and color category has not been available in any litter the Breeder will refund the application fee. If a puppy in the correct size, color and gender category is available and the Buyer decides not to take the puppy then the Buyer will lose their spot in line and the Application Fee is forfeit. (b) the Application Fee gives Buyer a “pick” place, but does not guarantee a puppy. Breeder always reserves the right to keep back any puppies for the breeding program from the litter before offering puppies to Buyers on the waitlist (c) pick places are given on a first-come first served basis according to when Breeder received the application fee and Buyer’s place in line is not negotiable; and (d) Breeder makes no guarantee of the puppy’s mature size, or that it will be show or breeding quality. Puppies are secured by deposit in an “as is” state, in reference to your choice of puppy at an early age, where exact color and coat pattern may change, and personality is not apparent. Breeder cannot and does not guarantee any specific qualities of the puppy when it becomes an adult. (e) When the puppies are (5-7) weeks of age depending on the litter and the Buyers on the waitlist will make their selections via video call within the category they selected when placing their waitlist deposit. The Breeder will arrange a video call time with the Buyers when they turn five weeks so that the Buyer behind you in line don’t have to wait too long to pick out their puppy. (f) If the Breeder tries to contact the Buyer through email, text and phone calls through the information listed on the application and the Buyer does not respond within 3 days the Breeder not required to hold Buyer’s place in line and the deposit is forfeit. (g) The puppy shall remain with the Breeder until they are 8 weeks old and/or have been cleared by the vet to take home. The Buyer agrees that all pick-up dates are to be set by the Breeder in the best interest of the puppy. If the puppy is not picked up within 5 business days of the notification to the Buyer that the puppies are available for pick-up the Breeder may then offer said puppy to another owner without any further obligation to the Buyer placing this deposit unless other arrangements have been made in writing. Breeder will do their best to work with everyone’s schedules to arrange a convenient time. Due to Covid and everything else happening in this world right now we will not longer be doing any pre-pickup visits at our house. We can do FaceTime calls so you can see the mother of the puppies and where they live.
Final Purchase Price.
Breeder and Buyer agree that (a) the Application Fee and Deposit shall be applied to the final purchase price of the puppy and (b) the remaining balance will become due before the puppy will leave the Breeder and/or ownership is transferred from Breeder to Buyer.
Governing Law. This Agreement, and all matters arising out of or relating to this Agreement, shall be governed by and construed in accordance with the laws of the State of Idaho without regard to the conflicts of laws provisions thereof.
